1. INTRODUCTION

Welcome to Hello. These Terms of Use (“Terms”) govern your access to and use of Hello’s services, including our website, mobile application, features, tools, and any related offerings (together, the “Service” or “Services”). Please read them carefully.

By creating an account or accessing the Service, you agree to be bound by these Terms, as well as our Privacy Policy, Cookie Policy, Community Guidelines, and Safety Tips, all of which are incorporated by reference. If you do not agree with any part of these Terms, you must not use Hello.

We may update these Terms from time to time as permitted by law. When we make material changes, we will update the “Effective Date” and may also provide notice via the app or email. Your continued use of Hello after any changes means you accept the revised Terms.

We may modify, discontinue, or adjust features, pricing, subscription tiers, or product offerings at any time.

2. ACCOUNT ELIGIBILITY AND RESPONSIBILITIES

2a. Eligibility Requirements

By using Hello, you represent and warrant that:

1. You are at least 18 years old.
   
   
2. You are legally capable of entering a binding contract.
   
   
3. You have not been convicted of or pled guilty/no contest to any felony, violent crime, sexual offense, or crime involving threats or harm.
   
   
4. You are not legally prohibited from using an online dating service.
   
   
5. You do not have more than one Hello account.
   
   
6. You have not previously been removed or banned from Hello or any affiliated service without our written permission to return.
   
   

If you cease to meet any eligibility requirement, your authorization to use the Service is automatically revoked.

2b. User Responsibilities

You agree to:

• Comply with these Terms and all Hello policies.
  
  
• Comply with all applicable laws and regulations.
  
  
• Use the most current version of the Hello app.
  
  
• Maintain accurate account information.
  
  
• Treat Hello users and staff respectfully on and off the Service.
  
  
• Maintain the security of your login credentials.
  
  
• Upload at least one clear photo of yourself showing your face.

2c. Prohibited Conduct

You agree NOT to:

• Misrepresent your identity, age, relationship status, background, or intentions.
  
  
• Harass, stalk, bully, threaten, or defame anyone.
  
  
• Request money, gifts, loans, or financial support from users.
  
  
• Engage in deception, fraud, scams, or impersonation.
  
  
• Use Hello for political, commercial, promotional, or fundraising purposes.
  
  
• Post or transmit viruses, malware, scraping tools, bots, automated systems, or unauthorized data extraction tools.
  
  
• Interfere with the operation of the Service or other users’ experience.
  
  
• Reverse-engineer, decompile, or attempt to extract source code from the Service.
  
  
• Evade bans, create replacement accounts, or misuse reporting tools.
  
  
• Build or use third-party tools, bots, or AI models to interact with the Service without authorization.
  
  

Your license to use the Service is automatically revoked if you violate these Terms.

2d. Prohibited Content

You agree not to post, upload, or transmit any content that:

• Contains nudity, pornography, sexual content, or graphic violence.
  
  
• Promotes hate, discrimination, bigotry, or extremism.
  
  
• Encourages self-harm or illegal activity.
  
  
• Is defamatory, obscene, misleading, or intentionally false.
  
  
• Shows minors without a parent or guardian present.
  
  
• Violates someone else’s privacy, publicity rights, or intellectual property rights.
  
  
• Advertises or links to outside websites, apps, promotions, or services.
  
  
• Is generated by AI but presented as real without clear disclosure.
  
  
• Damages Hello’s reputation or encourages misuse of the Service.
  
  

We may suspend or terminate accounts that violate these restrictions.

3. CONTENT AND LICENSES

3a. Your Content

You are solely responsible for the content you upload. By posting content, you represent that you have all necessary rights to do so.

You grant Hello a worldwide, perpetual, sublicensable, royalty-free license to host, store, reproduce, modify, adapt, publish, display, distribute, create derivative works from, and otherwise use Your Content for the operation, improvement, and promotion of the Service.

We may remove or restrict any content at any time for any reason.

3b. Member Content

Other users’ content belongs to them. You may not copy, distribute, reuse, or repurpose Member Content except within the Service as intended.

3c. Hello’s Content

All text, graphics, logos, images, software, trademarks, and other intellectual property on the Service belong to Hello and are protected by law. You may not use them except as permitted under these Terms.

3d. Copyright Policy (DMCA)

Hello respects the intellectual property rights of others and expects users to do the same.

If you believe that content on the Service infringes your copyright, you may submit a notice including:

• identification of the copyrighted work claimed to be infringed
  • identification of the material claimed to be infringing
  • your contact information
  • a statement that you have a good faith belief the use is unauthorized
  • a statement made under penalty of perjury that your notice is accurate
  • your physical or electronic signature

Hello may remove allegedly infringing content and may terminate accounts of repeat infringers where appropriate.

4. MISCONDUCT AND SAFETY

4a. Enforcement and Account Actions

We do not tolerate harmful or unsafe behavior. You may report misconduct through in-app tools.

Hello may take action for behavior occurring on or off the Service if it affects the safety or integrity of the community.

We may suspend, restrict, or terminate accounts without explanation where providing details would compromise user safety or privacy.

False or malicious reporting may result in account consequences.

Hello may investigate suspected violations of these Terms and take any action it determines appropriate, including removing content, restricting features, suspending accounts, terminating access to the Service, or referring matters to law enforcement where appropriate.

4b. User Interactions and Safety Disclaimer

Hello does not conduct criminal background checks on users and does not verify the accuracy of user statements or profiles. While we strive to promote a respectful and safe community, we cannot guarantee the identity, intentions, or behavior of any member.

You are solely responsible for your interactions with other users, both online and offline. You agree to use caution and good judgment when communicating with or meeting anyone through the Service.

To the fullest extent permitted by law, Hello is not responsible for the conduct of any user, whether on or off the Service.

Hello does not routinely conduct criminal background screenings on users unless explicitly stated within the Service.

5. PRIVACY

Your use of Hello is governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in that policy.

6. LICENSE TO USE THE SERVICE

Subject to your compliance with these Terms, Hello grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service.

7. RIGHTS YOU GRANT HELLO

By using the Service, you grant Hello the right to:

• Use Your Content for operating and improving the Service.
  
  
• Act on your behalf in copyright enforcement related to Your Content.
  
  
• Display advertising within the Service.
  
  
• Use feedback you provide without compensation.
  
  

We may access, preserve, and disclose account information if required by law or necessary to enforce these Terms or protect users’ safety.

8. PURCHASES, SUBSCRIPTIONS, AND BILLING

8a. Auto-Renewal

If you purchase a subscription or paid feature, it will automatically renew until you cancel.

Canceling a subscription does not delete your Hello account. To terminate membership entirely, you must delete your account.

8b. External Service Purchases (Apple/Google)

If you purchase through Apple or Google:

• Billing and cancellations must be completed through that external service.
  
  
• Refunds must be requested through the external service provider.
  
  
• Chargebacks may result in account termination.
  
  

8c. Internal Purchases

If you purchase through Hello directly:

• You authorize Hello to charge your chosen payment method.
  
  
• You remain responsible for uncollected amounts.
  
  
• Pricing may change, and we may notify you when required by law.
  
  
• Chargebacks may result in account termination.
  
  

8d. Refunds

Except where prohibited by law:

• All purchases are final and non-refundable.
  
  
• Virtual items (if ever introduced) have no cash value and are non-refundable.
  
  

9. ACCOUNT TERMINATION

Hello may suspend or terminate your account at any time for violating these Terms, endangering users, or acting inappropriately on or off the Service.

You may delete your account at any time through Settings.

Even after termination, certain provisions of these Terms survive, including those relating to content rights, limitations of liability, and dispute resolution.

10. DISCLAIMER OF WARRANTIES

The Service is provided “as is” and “as available,” without warranties of any kind.

We will do our best to provide, but we cannot guarantee:

• uninterrupted access
  
  
• error-free operation
  
  
• accurate or complete content
  
  
• successful matches
  
  
• identity or intentions of any user
  
  

You use the Service at your own risk.

11. LIABILITY AND INDEMNIFICATION 

11a. Limitation of Liability

To the maximum extent permitted by law:

• Hello is not liable for indirect, consequential, special, exemplary, or punitive damages.
  
  
• Our total liability for any claim is limited to the amount you paid Hello in the 24 months preceding the claim.

11b. Indemnification

You agree to indemnify, defend, and hold harmless Hello and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your use of the Service
  • your content
  • your interactions with other users
  • your violation of these Terms
  • your violation of any law or the rights of any third party

Hello reserves the right to assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with that defense.

12. DISPUTE RESOLUTION AND ARBITRATION

Before initiating formal dispute resolution, you agree to first contact Hello and attempt to resolve the dispute informally.

Except where prohibited by law, any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration will take place in the county where Hello is headquartered unless otherwise required by law.

You agree that disputes will be resolved only on an individual basis. You waive the right to participate in any class action, class arbitration, or representative proceeding.

Either party may bring an eligible claim in small claims court where permitted by law.

13. GOVERNING LAW

These Terms are governed by the laws of the state in which Hello is headquartered, except where otherwise required by applicable law.

State Compliance Override

To the extent any state or local laws provide consumers with specific rights or impose requirements regarding subscriptions, renewals, cancellations, fees, or related disclosures, those laws shall apply and shall override these Terms where required by law.

14. MISCELLANEOUS

These Terms constitute the entire agreement between you and Hello.

If any provision is found unenforceable, the remainder of the Terms will remain in effect.

Failure to enforce any part of these Terms does not constitute a waiver.

You may not assign these Terms without our consent.
